ORDER

The petitioner has challenged the impugned communication dated 20.01.2026 issued by the second respondent requesting police assistance for conducting survey and demarcation of the boundaries of the subject property.

2. The grievance of the petitioner is that certain third parties are trying to encroach upon the petitioner's property by bringing a Bulldozer and claiming that they are going to survey the land. The petitioner has filed supporting documents along with this writ petition for the purpose of establishing that they are the owner of the subject property. This Court is not expressing its view with regard to the merits of the said documents. However, any survey and demarcation of the boundaries of the property can be done by the revenue authorities only after hearing the objections of all the necessary parties, which includes the petitioner who claims that he is the absolute owner of the subject property, and he has also filed supporting documents along with this writ petition in order to prove the same.

It is also submitted by the learned Government Advocate for the respondents 1 and 2 that due to law and order issue, survey and demarcation of the boundaries of the subject property could not be conducted by the revenue authorities. The said statement made by the learned Government Advocate is recorded.

4. All the objections that have been raised by the petitioner with regard to survey and demarcation of the boundaries of the subject property will have to be raised before the revenue authorities, as and when they initiate the said process. Accordingly, this writ petition is disposed of by directing the petitioner to raise all the objections, that have been raised in this writ petition, with regard to survey and demarcation of the boundaries of the property, which is the subject matter of this writ petition, before the official respondents, and once the petitioner submits written objections, necessarily the official respondents will have to consider the same and only thereafter, decide as to whether the survey and demarcation of the boundaries of the subject property can be done or not. No Costs. W.M.P.No.4381 of 2026 is closed.
