IN THE HIGH COURT OF JUDICATURE AT MADRAS
( Special Original Jurisdiction ) Monday, the Twelfth day of February Two Thousand Eighteen PRESENT THE HON`BLE MR.JUSTICE SATRUGHANA PUJAHARI WMP No.9530 of 2017 in WP No.8698 of 2017 J.ARIVAZHAGAN [ PETITIONER ] Vs 1 THE CHAIRMAN CUM MANAGING [ RESPONDENTS ] DIRECTOR, TAMIL NADU GENERATION AND DISTRIBUTION CORPORATION LTD., 144 ANNA SALAI, CHENNAI 2 2 THE CHIEF ENGINEER PERSONNEL TAMIL NADU GENERATION AND DISTRIBUTION CORPORATION LTD., 144 ANNA SALAI, CHENNAI 2 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to issue an order of ad interim injunction, restraining the respondents from issuing order of appointment to candidates shown in the select list, pending WP.No.8698 of 2017.
Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.K.KRISHNAMOORTHY, Advocate for the petitioner and of MRS.R.VARALAKSHMI STANDING COUNSEL on behalf of the Respondents the court made the following order:- Heard learned counsel appearing for the petitioner and also the learned counsel appearing for opposite party. 2.
It appears that the petitioner has challenged the selection list published by Tamil Nadu Generation and Distribution Corporation Limited (TANGEDCO) for ignoring him to include in the selection list on the ground that though he was qualified having necessary cut off marks, also being a physically challenged person and holding a priority certificate in employment, the petitioner not called to the interview for selection.
3.
In the Writ miscellaneous petition, he had made a prayer to direct the opposite party not to appoint any person, but taking
into consideration the facts and circumstances of the case, while issuing notice, this Court had directed to keep only one post reserved.
4. Heard the learned counsel appearing on either side. 5.Considering the facts and circumstances, especially the fact that this Court had already directed the respondent to keep one post reserved, pending disposal of the writ petition for accommodation of the petitioner and the respondent has given appointment to others keeping reserve one post, the prayer to injunct not to give appointment to anyone, hereinafter is therefore, became infructuous and also otherwise devoid of merit. Hence, the same stands dismissed.
