CMP Nos.3497, 3499 of 2021 CMP Nos.3497 and 3499 of 2021 in SA Sr. Nos.13903 and 13904 of 2021 S. S.SOUNTHAR, J.

CMP No.3497 of 2021: This petition has been filed to condone the delay of 151 days in preferring the second appeal against the judgment and decree passed in A.S.No.57 of 2015 dated 27.08.2019.

CMP No.3499 of 2021: This petition has been filed to condone the delay of 302 days in preferring the second appeal against the judgment and decree passed in A.S.No.58 of 2015, dated 27.08.2019.

2. The learned counsel for the petitioner/appellant as well as the 2nd and 3rd respondent would submit that the 2nd and 3rd respondents are the legal representatives of the deceased first respondent.

3. The statement made by the learned counsel for the appellant and the respondents 2 and 3 are recorded. The Registry is directed to carry out amendment in the cause title.

4. Being satisfied with the reasons assigned in the affidavits filed along with the respective petitions and upon hearing the learned counsel appearing for the petitioner as well as the 2nd and 3rd respondent, the above said delay in filing the second appeals is condoned.

5. The Registry is further directed to number the second appeals, if it is otherwise in order and the list the same for admission, after making necessary amendment.
