Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, to call for the records on the file of the first respondent E-auction notification specification No.SE/CD&HP/04/2020-21 dated 13.01.2021 with respect for clause 6(II) and (III) and to quash the same as illegal and incompetent and without jurisdiction.

Today when the matters are taken up for hearing, the learned Standing Counsel appearing for the respondents filed memo and it revealed that the impugned tender consists of two stages. The first stage was receipt of technical bids on or before 12.02.2021, 2.00 p.m. The second stage was the live e-auction to be conducted by M/s.MSTC, government of India undertaking in their E-auction portal for the bidders

qualified in the technical bid evaluation. Now the tender has been cancelled as per the directions of the second respondent by its meeting held on 18.06.2021. Hence, the tender itself over and the prayer sought for in these writ petitions has become infructuous and nothing survive in these petitions.

Considering the submissions made by the learned Standing Counsel appearing for the respondents, all the Writ Petitions stand dismissed as infructuous.
