This Criminal Original Petition has been filed to call for the records pertaining to the C.C.No.769 of 2015 on the file of the learned Judicial Magistrate-II, Coimbatore and quash the same.

2. None appeared on behalf of the petitioner side.

3. The learned counsel appearing for the respondent would submit that the trial has already been commenced and PW1 was already examined. Hence, he prayed for dismissal of the above petition.

4. It is seen that when the matter was posted on 18.03.2016 "For Admission", the learned counsel appearing for the petitioner took an adjournment and the matter was adjourned to 25.04.2016. Thereafter, for the past four years, the learned counsel has not taken any steps to list the matter. It shows that the petitioner has no interest to pursue the matter. Further it is pending for more than four years without even ordering notice. Now after the lapse of four years period, this petition cannot be considered and this Court is not inclined to entertain this petition.

5. In view of the above, this Criminal Original Petition is dismissed. And Connected Miscellaneous Petition is dismissed.
