Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the records connected with the order of dismissal passed by the second respondent in Na.Ka.No.2740/Aa/96 dated 27.12.2000 and quash the same and further direct the respondents to reinstate the petitioner with continuity of service, back wages and other attendant and service benefits. Petitioner has come up with this Writ Petition challenging the order of dismissal passed by the 2nd respondent vide Na.Ka.No.2740/Aa/96, dated 27.12.2000 and for a consequential direction to the Respondents to reinstate her with continuity of service, back wages and other attendant and service benefits. 2.
Today, when the matter was taken up for hearing, learned Special Government Pleader appearing for the Respondents, drawing attention to paragraph 5 of the counter filed by the Respondents submitted that, the Petitioner has been
reinstated into service and he attained superannuation on 30.06.2013 and all the terminal benefits have been extended to him. He also submitted that, the relief sought by the Petitioner has been granted.

For better appreciation, paragraph 5 of the counter Affidavit is extracted hereunder:
"5.It is submitted that, as per the directions of Hon'ble High Court in W.P.No.18625 of 2003, Medical Leave Salary, Bonus, Pay Commission Arrears and Interest for the belated payment of Subsistence Allowance for a sum of Rs.24,197/- was paid to the petitioner on 19.04.2013. As per the orders of Hon'ble High Court in W.P.No.32870 of 2005, the petitioner was re-instated on 21.08.2006. After that, the salary arrears for the removal of service period of the petitioner from 27.12.2000 to 31.08.2006 for a sum of Rs.1,04,571/- was paid to the petitioner on 19.06.2009. The petitioner was retired from Government Service on 30.06.2013 and retirement benefits also paid to the petitioner. As on date, there is no due of subsistence allowance was pending with the 2nd respondent. For the foregoing reasons the Writ Petition has become infructous as devoid of merits."

In view of the above, as the relief sought by the Petitioner has been granted, nothing further survives for consideration in this matter. Hence, this Writ Petition is dismissed as having become infructuous. No costs. Sd/- Assistant Registrar //True Copy// Sub Assistant Registrar (aeb/jas) To:
