O R D E R
The Criminal Appeal Case has been filed against the order of acquittal. The appellant is the complainant in a private complaint for the offence under Section 138 of Negotiable Instruments Act in C.C.No.582 of 98 on the file of the Judicial Magistrate No,VI at Coimbatore. Now, challenging the said order of acquittal, the appellant is before this Court with this criminal appeal.
2. Today, when the matter was taken-up for hearing, the learned Government Advocate (Crl. Side) submits that pending appeal, the sole accused died on 25.05.2013 and he also filed a memo along with death certificate.

3. In view of the submission and based on the memo filed by the learned Government Advocate (Crl. Side), this Criminal Appeal is dismissed as abated.
