ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offences under Sections 379, 430 of IPC r.w 21(1) of the Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.31 of 2022, on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that when the respondent police was on vehicle inspection, they found that the petitioner was involved in illegal transportation of three units of river sand, without any valid permission from the concerned authority. Hence, the respondent police registered a case against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent Police would submit that the petitioner has four previous cases similar in nature. He further submits that the https://hcservices.ecourts.gov.in/hcservices/

investigation is still pending and therefore he prayed for dismissal of this petition.

Heard both sides.

Now, on considering the submissions made by the counsels appearing on the either side, though the learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in this case, since the investigation is pending, this is not a time to consider the prayer sought out in this petition. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner
