PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records of the first respondent herein, pertaining to the order bearing No.38867/05/R1 dated 24.06.2005 and quash the same and consequentially direct the first respondent to grant the lease of the daily market rights, only by way of public auction.

The writ petition is filed challenging the renewal of lease granted in favour of the second respondent. The period of lease has already expired. The grievance of the writ petitioner is that public auction had not been conducted as per the law. https://hcservices.ecourts.gov.in/hcservices/

2.It is made clear that all public auctions are to be conducted in the manner known to law and public properties are to be dealt with by competent authorities transparently, by providing equal opportunities to all the bidders. However, in the present case, the period of lease had already expired and therefore, no further adjudication is required at this point of time.
