PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, directing the 2nd and 3rd respondent to give effect to the order dated 22.08.2023 passed by the Honble Madras High Court in WA.No. 1194 of 2018 and release the lands from proceedings under the Tamil Nadu Urban Land (Ceiling and Regulation) Act, 1978 and consequently direct the 4th respondent to issue patta in favour of the petitioners. ORDER
The petitioner asserts title under sale deed dated 20.03.2007 bearing Document No.3808 of 2007 in respect of 1800 sq.ft in Plot No.73. Tracing title from one Arumugam, it is further asserted that the legal heirs of Arumugam filed W.A.No.1194 of 2018, which was allowed on 22.08.2023. On the ground that the lands currently owned by the petitioner forms part of the larger extent covered by the order of the Division Bench, the petitioner seeks consideration of the request for release of lands from proceedings under the Tamil Nadu Urban Land (Ceiling and Regulation) Act, 1978.
2. Mr.Abishek Murthy, learned Government Advocate, accepts notice for all the respondents. He submits that the petitioner's representation would be considered and disposed of on merits within two months by the third respondent.
3. The petitioner relies upon order dated 22.08.2023 in W.A.No.1194 of 2018 on the basis that 5862 sq.ft. purchased by him under sale deed dated 10.07.2006 forms part of the larger extent covered by the judgment of the Division Bench. This aspect has to be verified by the third respondent while considering the representation of the petitioner. If it transpires that it is covered, the judgment of the Division Bench would hold the field and the petitioner would be entitled to the relief claimed.
4. With the above observations, the writ petition stands disposed of by directing the third respondent to consider and dispose of the petitioner's representation dated 22.10.2025 by taking note of the observations in this order. There will be no order as to costs.
