Civil Miscellaneous Appeal filed against the order and decree dated 26.10.2016 made in I.A.No.14 of 2016 in D.O.P.No.4 of 2015 on the file of the Family Court at Udhagamandalam, The Nilgiris.
Order: This Civil Miscellaneous Appeal coming on for hearing on this day in the presence of Mr.Ma.P.Thangavel, Advocate for the appellant and Mr.T.Shanmugam, Advocate for the Respondent during the pendency of the Civil Miscellaneous Appeal have entered into compromise and filed into court a Joint Memo for compromise duly signed by the appellant and Respondent and the respective advocates and upon perusing the memorandum of grounds of Civil Miscellaneous Appeal, the decree and judgment of the court below the records in this case and joint memorandum of compromise, the Original which is annexed hereto this Court doth record the said joint memorandum of compromise and in terms thereof order and decree as follows:
1.that the appellant and respondent are husband and wife and due to some misunderstanding they lived separately from the past 7 years. The Appellant husband has filed a Divorce petition before the Family Court at Ootacamund and the same is still pending in DOP.No.4 of 2015 in IA.14/2016. The Husband Appellant has filed an appeal before this Honourable Court against the order in IA.14/2016 passed by the Honourable Family Court of Ootacamund and the same is pending before this Honourable court in CMA.No.2742 of 2016.
2.that the husband/appellant and wife/respondent both settled their dispute out of court and rejoined into their matrimonial life and living as husband and wife wih their minor daughter happily from the past 5 months thereby presently the husband and wife are living https://hcservices.ecourts.gov.in/hcservices/
happily without any dispute and regret for the unpleasant happenings in our life. The husband and wife both are not interested in further proceedings of the cases pending before the Honourable Courts of law. 3.That the recording the above joint compromise memo dated 20.02.2021 the Civil Miscellaneous Appeal is disposed of.
4.That there shall be no costs in this Civil Miscellaneous Appeal.
