The petitioner, who apprehends arrest for the alleged offences punishable under Section Man missing altered to Sections 147,148,341,294(b),324,302 of I.P.C 1860 in Crime No.308 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. Totally there are eight accused in this case and the petitioner herein arrayed as A2. The case of the prosecution is that due to previous enmity the petitioner along with other accused murdered the deceased and also attacked the defacto complainant brutally. Hence the complaint. 3.The learned counsel for the petitioner would submit that the petitioner was only present at the scene of occurrence, that apart he has not committed any crime as alleged by the prosecution. Hence prays for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) would submit that due to previous enmity the petitioner along with other accused murdered the deceased and also attacked the defacto complainant brutally. Hence he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and the nature of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the Criminal Original Petition is dismissed. 08.02.2023 smn
