Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing respondents 1 and 2 to take appropriate action to prevent the illegal and unauthorized construction of 6th respondent in Door No.19/8, Ramanathan Street, Ayanavaram, Chennai -600 023, by considering the petitioner's representation dated 22.12.2025. For Petitioner :

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The grievance as ventilated by the petitioner in the petition is that the sixth respondent has raised an illegal construction, which is adjacent to the house of the petitioner, causing obstruction to light, air etc.

2. Upon instruction, learned counsel for the respondents 2 to 5, appearing on advance copy, would submit that taking cognizance of the complaint of the petitioner, notice has now been issued to the sixth respondent, requiring him to submit necessary documents, which shall necessarily be followed by a proper investigation and decision would

be taken in the matter by the authority, one way or the other, as to whether there is any deviation or not; and if any deviation is found, appropriate action would be taken as per law.

3. In view of the statement so made, we are inclined to dispose of the petition with a direction that inquiry, as opened against the sixth respondent, be concluded within a period of three months and a decision, as may be required under the law, be taken by the authorities promptly.

4. We make it clear that the sixth respondent shall be given sufficient time and opportunity of hearing, as contemplated under the law.
