This application is filed by the applicants/plaintiffs to summon the Sub Registrar, Joint-II, Saidapet, as mentioned in the Judges Summons as witness in the above suit.
2. Heard both side.
3. The learned counsel for the applicants/plaintiffs submitted that the plaintiffs had approached the jurisdictional Sub Registrar and sought for the certified copies of the same. However, it was reported by the office of the Sub Registrar that the documents pertaining to the year 1965 have been extensively damaged and that certified copies of the same cannot be provided. If the Sub Registrar is summoned and only upon his evidence, this Court could come to a conclusion as to their document and as to the genuineness of the plaintiffs' sale deed. Hence it is just and necessary to summon the Sub Registrar as witness.
4. The learned for the respondents/defendants 4 and 5 has strongly opposed to allow this application stating that a direction cannot be given to the Sub Registrar to produce the damaged documents. Hence, he prays for dismissal of this application.
5. Having satisfied with the reasons stated in the affidavit, this Court is inclined to allow this application. Accordingly, the Sub Registrar, Joint-II, Saidapet is directed to appear before the Additional Master-IV for https://www.mhc.tn.gov.in/judis
examination with the available records pertaining to the sale deed vide document No.852 of A.A.NAKKIRAN, J.
uma 1965 dated 24.03.1965, on 25.03.2025.
6. The Registry is directed to list the matter before the Additional Master-IV for recording evidence on 25.03.2025. 11.03.2025 uma Note: The Registry is directed to send a communication to the Sub Registrar, Joint-II, Saidapet.
