Petition filed under Article 226 of the Constitution of India for the issuance of writ of mandamus, directing the fourth respondent to act upon the representation of the petitioner dated 03.02.2014 in accordance with law and consequently reinstate the petitioner as temporary sub staff of the third respondent bank. O R D E R
The petitioner was initially engaged as Casual Labourer by the first respondent in May 2009. The Bank opened a Branch at Krishnagiri. Thereafter, the petitioner was appointed as a Sub-Staff at Krishnagiri by the 4th respondent, pursuant to proceedings dated 22.06.2011. She joined the Krishnagiri Branch of Corporation Bank on 04.09.2011. She was also paid the bonus at the applicable date. The petitioner was not permitted to work after December 2013, inspite of her completion of four years of continuous service. The petitioner therefore submitted a representation on 03.02.2014 requesting the fourth respondent to permit her to do work as before. Since the said representation was not taken up for consideration, the petitioner is before this Court.
2. Heard the learned counsel for the petitioner and the learned Standing Counsel on behalf of Corporation Bank.
3. The fourth respondent is directed to consider and dispose of the representation submitted by the petitioner on 03.02.2014 on merits and taking into account her earlier service borne out by records. Such exercise shall be completed within a period of four months from the date of receipt of a copy of this order.
4. The writ petition is disposed of with the above direction. No costs.
