This application is filed by the defendants to condone the delay of 225 days in filing the written statement. On instructions, learned counsel for the plaintiff submits that he has no serious objection to this application being allowed.

2. In the affidavit in support of this application, the defendants have stated that the second defendant was suffering from a heart ailment and, therefore, could not provide necessary instructions to counsel. She has further stated that the suit schedule property was bequeathed in her favour and she is in absolute possession and enjoyment thereof.

3. Upon being satisfied that the above reasons constitute sufficient cause, this application is allowed. Consequently, the Registry is directed to receive the written statement of the defendants 1 to 4.

4. List the A.No.986 of 2023 on 09.03.2023.
