PRAYER : Petition under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, calling for the records pertaining to the proceedings of the 1st respondent dated 25.07.2003 made in Mu.Mu.No.31937/N2/2003 and the consequential order passed by the 2nd respondent dated 05.02.2005 made in Mu.Pa.No.1852/1999 (S2), quash the same and consequently direct the 1st respondent to decide the petitioner's appeal Memorandum dated 30.06.2003 on merits. Heard Mr.N. Manokaran, learned counsel for the petitioner and Mr.P.P.Purushothaman, learned Government Advocate for the respondents.

2. With consent of learned counsel on either side, this writ petition itself is taken up for final disposal. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Government Advocate submits that the additional stamp duty and registration charges demanded by the respondent have been paid by the petitioner and the document has been released to the said effect. The learned Government Advocate has also produced a copy of the communication issued by the 3rd respondent to the 2nd respondent dated 02.03.2020.

4. The learned counsel for the petitioner submitted that he does not have any instructions and in fact, an adjournment is sought for.

5. Considering the fact that the petition is of the year 2005, this Court is not inclined to grant an adjournment. By recording the statement of the learned Government Advocate, the writ petition stands closed. However, if there is any change of circumstance, liberty is granted to learned counsel for petitioner to mention and restore the writ petition. No costs. Connected miscellaneous petition is closed.
