ORDER
This petition has been filed to relax the condition that the petitioners shall appear before the respondent police on the first day of every month at 10.30 a.m., until further orders imposed in Crl.M.P.No.10568 of 2023 in Crl.O.P.No.4243 of 2023 dated 31.07.2023.
2. Learned Government Advocate (Crl.Side) submitted that the first and third petitioners have been complying with the condition regularly imposed by this Court; and that the second petitioner has not complied with the condition even once.
3. Considering the submissions of both sides and the nature of the offence, the condition in paragraph no.8(b) imposed on the first and third Page No.2 of 4
petitioners in Crl.O.P.No.4243 of 2023 dated 17.03.2023 and subsequently modified in Crl.M.P.10568 of 2023 is relaxed.
4. Accordingly, the Criminal Miscellaneous Petition is ordered insofar as the petitioners 1 and 3 are concerned.
5. Since the second petitioner has not complied with the condition imposed on him by this Court in Crl.O.P.No.4243 of 2023 dated 17.03.2023, this Court is not inclined to relax the condition. Accordingly, the Criminal Miscellaneous Petition is dismissed insofar as the second petitioner is concerned.
