A.S.No.974 of 2020 C.M.P.No.3876 of 2024 in A.S.No.904 of 2010 RMT.TEEKAA RAMAN. J., Before the Trial Court, the respondents R2 to R5 were remained ex-parte, and hence, in the appeal notice to them was dispensed with initially.

2. Now, it is represented by Mr. A. Muthukumar, learned counsel for the appellant that the respondents R3 to R5 are the legal heirs of the deceased second respondent.

Therefore, as legal heirs of the second respondents, they are necessary parties in the appeal, and hence notice has to be issued.

3. Hence, C.M.P. No.3876 of 2024 is ordered as prayed for.

4. Issue notice in A.S.No.904 of 2010 to the newly added parties, returnable in three weeks. Private notice is also permitted. AOS has to be filed.

5. Post the matter after three weeks.
