JUDGMENT

The petitioner before the Labour Court in an action founded on Workmen's Compensation Act has preferred this appeal challenging the interest portion of the order of the Labour Court. The said order is an exparte order. The learned counsel for the respondent brought to the notice of this Court that he had filed I.A.No.5 of 2018 and the same has since been allowed. The appellant concurred the said statement.

2. In view of the fact that the exparte order now stands set aside, nothing survives in this case and the appeal is dismissed as it has become infructuous. The Deputy Commissioner of LabourI, Chennai is directed to dispose of the matter within a period of three months from the date of receipt of a copy of this order. No costs.
