A.Nos. 1393 to 1395 of 2024 in TOS.No. 31 of 2009 A.A.NAKKIRAN, J A.No.1393 of 2024, is filed to condone the delay of 55 days in filing the application to set aside the abatement in the suit; A.No.1394 of 2024, is filed to set aside the abatement in the suit; and A.No.1395 of 2024, is filed to bring on record the Legal Representatives of the deceased 1st defendant, namely, B.Dhanabalakrishnan died on 13.08.2023, leaving behind the proposed legal representatives viz., (i) D.Kalavathi (wife), (ii) D.Udayakumar (son), D.Kavitha (daughter) and (iv) D.Kamalakannan (son).

2. Heard both side and perused the records.

3. The learned counsel appearing for the respondents/defendants submitted that he has no serious objection in allowing these applications.
