PRAYER: Contempt Petition filed under Section 11 of the Contempt of Courts Act 1971, praying to summon the respondent herein and consequently punish by awarding punishments for their act of contempt of court by flouting the order dated 17.07.2013 passed by this Court in M.P.No.1 of 2013 in W.P.No.19526 of 2013.

ORDER

The learned counsel for the petitioner would submit that the employee had now reached the age of superannuation and has retired.

2. The contempt petition is against an order of interim stay of the transfer order. The grievance of the petitioner seems to be that he has not been disbursed with the monetary benefits.

3. If that be so, liberty is hereby granted to the petitioner to work out his remedies by challenging the same through a separate proceedings. As such, the disobedience alleged in the present contempt petition cannot be termed as willful in nature, in view of the present status.
