Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondent to survey of the petitioner's land comprised in S.No.314/2 measuring to an extent of 0.4.50 hectare situated in Alamarathupatti Village, Mettur Taluk, Salem District by considering his application dated 17.09.2020 within a time frame fixed by this Hon'ble Court.

ORDER

This Writ Petition is filed for a writ of Mandamus directing the respondent to survey the petitioner's land comprised in S.No.314/2 in Alamarathupatti Village, Mettur Taluk, Salem District by considering his application dated 17.09.2020 2.Mrs.R.Janaki, learned Additional Government Pleader takes notice for the respondent and made a statement on instructions that on the direction of the respondent/Tahsildhar, when the Surveyor concerned has visited the property on 09.02.2021, they faced some resistance from the adjacent land owners, which threatened to create some law and order problem. Now, the Surveyor has proposed to visit the property on 24.02.2021 at 11.00 a.m. with police protection.

3.The said statement of the learned Additional Government Pleader is recorded.

4.In view of the above, no further direction is required to be given except that the respondent is directed to issue notice to all the parties who are likely to be affected by his decision, provide them a fair and effective hearing and to dispose of the representation of the petitioner through a speaking order within a period of twelve (12) weeks from the https://hcservices.ecourts.gov.in/hcservices/

date of receipt of a copy of this order, subject to the period, if any lost for the responsibilities associated with the conduct of the General Elections, 2021.
