O R D E R
This Criminal Revision Case has been filed against the order dated 06.08.2024 passed in Crl.MP.No.38798 of 2024 in crime No.204 of 2023 on the file of the V Metropolitan Magistrate At Egmore, thereby dismissed the petition filed for seeking to return the petitioner's son's vehicle. 2.
The petitioner's son owned a vehicle-two wheeler bearing
registration No.TN 10 BS 3845 Yamaha AEROX 156 BIKE. He involved in the offences under Sections 147, 148, 341, 294(b), 323, 324, 307, 336, 427 & 506(2) of IPC in crime No.204 of 2023 on the file of the respondent. In pursuant to the registration of FIR, the aforementioned vehicle, which was used while committing the offence, was seized from the accused. However, A5/ the petitioner's son died on 04.08.2023. Therefore, the petitioner, who is the mother of A5, filed a petition to return the vehicle. However, the said petition was dismissed. According to the case of the prosecution, all the accused persons came with their respective motor cycles and committed the offence. Since A5/the petitioner's son died, this Court is inclined to return the vehicle to the petitioner.

Accordingly, the impugned order dated 06.08.2024 passed in Crl.MP.No.38798 of 2024 in crime No.204 of 2023 on the file of the V Metropolitan Magistrate At Egmore, is hereby set aside. The learned V Metropolitan Magistrate At Egmore, is directed to return the vehicle-two wheeler bearing registration No.TN 10 BS 3845 Yamaha AEROX 156 BIKE, to the petitioner, forthwith on the following conditions:- (i) the petitioner is directed to execute a own bond for a sum of
Rs.25,000/- (Rupees Twenty Five Thousand only) to the satisfaction of the concerned Magistrate to the credit of crime No.204 of 2023 pending on the file of the respondent police.
(ii) the petitioner shall deposit the original registration certificate of the vehicle with the concerned Magistrate.
(iii) the seized item should be photographed at the cost of the petitioner herein and a list is to be prepared and the same is to be signed by the petitioner. (iv) the petitioner shall not alienate and shall not make any alteration in the vehicle.
(v) the petitioner shall produce the vehicle before the Court and before the respondent police as and when required;
(vi) If any of the conditions are violated, this order automatically stands cancelled.
