ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 25.09.2021 by the respondent police for offences under Sections 393, 397of I.P.C @ 393, 398 of I.P.C in Crime No.880 of 2021, seeks bail.
2. The case of the prosecution is that the petitioner is alleged to have attempted to commit robbery at knife point.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged offences and he has been falsely implicated in this case. He further submitted that the petitioner has been in jail from 25.09.2021. Hence he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Government Advocate (Crl. side) submitted that, this is the 3rd bail petition filed by the petitioner and the earlier bail petitions filled by the petitioner were dismissed on the ground that, there are previous cases under section 302 of IPC are pending against the petitioner and there is no change in circumstances after the previous orders were passed on merits. Hence, the learned Government Advocate vehemently opposed to grant bail to the petitioner.
5. In view of the submission made by the learned Government Advocate, no change of circumstances arises for considering the third bail petition. Hence, this Criminal Original petition is dismissed.
