..Respondent Criminal Original Petition has been filed under Section 482 Code of Criminal Procedure to set aside the order in CRP.No.21 of 2017 dated 12.12.2017 passed by the Principal District and Sessions Judge, confirming the order of the learned Judicial Magistrate, Palladam in C.M.P.No.2196 of 2017 and consequentially direct the respondent to return the cash of Rs.7,90,000/-.

O R D E R

This criminal original petition has been filed to set aside the order passed by the Court below rejecting the petition for returning the case of Rs.7,90,000/- deposited to the credit of Crime No.18 of 2017 for the offence under Section 420 of IPC as against the petitioner and the other six accused persons.

2.The learned Additional Public Prosecutor appearing for the respondent submitted that there are very serious allegations in the complaint and they are yet to arrest some of the accused persons and the investigation is in progress. Further, he submitted that the order passed by the Court below to reject the petition filed by the petitioner to return the cash and a report with regard to the deposited money has been sent to the Income Tax Department and in the Income Tax Department, enquiry is pending.

3.Therefore, this Court finds that no merits in the petition and there is no irregularity in the order passed by the Courts below. Therefore, this court is not inclined to entertain this writ petition. Hence, this Criminal original https://hcservices.ecourts.gov.in/hcservices/

Petition is dismissed. However, the respondent is directed to complete the investigation and file a final report within a period of four months from the date of receipt of a copy of this order before the Court concerned.
