Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorarified Mandamus, praying to call for the records connected with the Proceedings of the First Respondent in Na. Ka. No. 216/2009 dated 06.07.2009 and quash the same insofar as it has not allowed the scale of pay of the pump operator, viz., Rs. 950-20-1150-25-1500 in the Ordinary Grade (V Pay Commission) to the Petitioner as ordered in G.O. Ms. 588 dated 01.08.1992 and further direct the First Respondent to implement the proceedings in Na. Ka. No. 932/95 dated 20.10.1995 and Na. Ka. 11/96 dated 20.02.1996 both passed by the First Respondent from 01.06.1988 with monetary effect from 01.04.1992 and other consequential benefits of the Fifth and Sixth Pay Commission pay etc.

(through video conference) Learned Counsel for the Petitioner states that the Petitioner has expired after the filing of the Writ Petition and that he would send a confirmatory memo to that effect through email, which shall be placed on record. 2.

In view of the same, the Writ Petition is dismissed as abated with a clarification that the legal representatives of the deceased Petitioner are not precluded from applying for revival of the Writ Petition in the manner, if they are otherwise entitled, in accordance with law.
