Respondent Prayer: Petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondent to dispose the Eviction Application filed by the petitioner on 22.11.2021 and thereby provided administrative assistance on an expeditious basis under Section 14 of the SARFAESI Act to take possession of the secured assets with respect to the application filed by the petitioner in Crl.M.P No. 22 of 2022 before the respondent.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The writ petition has been filed to seek a direction on the Chief Judicial Magistrate, Tiruvallur to expeditiously decide the application filed under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short, "the Act of 2002"). The application aforesaid was filed on 22.11.2021, almost three months back.

2. We do not find delay in disposal of the application filed under Section 14 of the Act of 2002 and otherwise, the Chief Judicial Magistrate, Tiruvallur is expected to decide the application filed under Section 14 of the Act of 2002 at the earliest.

3. With the aforesaid observation, the writ petition is disposed of. No costs.
