J U D G M E N T

(Judgment of the Court was delivered by R.SUBRAMANIAN, J.) Challenge is to the order of the learned Single Judge made in WP No.18001 of 2024 dated 09.07.2024. Challenge in the writ petition was to the proceeding dated 14.12.2012, in and by which, the sixth respondent was appointed as a Junior Draughting Officer in the priority quota reserved for 2/6

heirs of Freedom Fighters.

2. The petitioner had filed another Writ Petition in WP No.3249 of 2017, challenging his non selection, which came to be disposed of by this Court on 06.03.2020, on the conclusion that though the petitioner was sponsored under the priority quota, the sixth respondent was found to be more meritorious in the said quota. This order has admittedly become final. Now the petitioner wants to reopen the issue by claiming that the sixth respondent does not belong to the priority category and therefore, his appointment is illegal.

We do not think we can go into the question at present, moreover, the only document that is relied upon by the petitioner to demonstrate that the sixth respondent does not belong to the priority category is a list of persons, who had been granted Freedom Fighter as well as Tamil Scholar Pensions in Ramanathapuram District. That alone cannot be a basis to come to the conclusion that the predecessors of the sixth respondent were not either Freedom Fighters or Tamil Scholars.

4. Hence we see no merit in the Appeal, the Appeal fails and it is accordingly dismissed. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
