This Criminal Revision case is filed under Sections 397 read with Section 401 of Cr.P.C. praying to call for the records relating to the proceedings of I Additional Sessions Judge, Coimbatore, in Crl.R.C.No.101 of 2010 dated 12.01.2011 pertaining to item No.114 to 118 of seizer mahazar against the order of the learned Judicial Magistrate III, Coimbatore, in C.M.P.No.4649 of 2010 dated 06.10.2010 and set aside the same. This criminal revision has been filed against the order of dismissal of the petition seeking return of properties and this petitioner is 3rd party to the proceedings.

When the matter is taken up for hearing, the learned counsel appearing for the petitioner as well as the learned Government Advocate (Crl.Side) appearing for the respondent police would submit that the main case in C.C.No.55 of 2011 itself has been disposed of and the case ended in acquittal and produced a piece of proof for the same.

In view of the above submissions, nothing survives in the present criminal revision case and hence the same is dismissed as infructuous. Consequently, connected miscellaneous petition is closed.
