Writ Petition filed under Article 226 of the Constitution of India praying to issue a Certiorarified Mandamus, calling for the records relevant to the notice dated 17.05.2005 passed by the respondent and quash the same as illegal, improper, unreasonable, arbitrary and against the rule of law and natural justice and thereby direct the respondent to permit the petitioner to pay the true balance amount on instalment basis.

O R D E R

The relief sought for in the present Writ Petition is to quash the notice dated 17.05.2005, issued by the respondent.

2. On a perusal of the impugned notice, it was issued under Section 13 (2) read with Section 13 (3) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Ordinance, 2002.

3. In view of the efflux of time, the cause aroused for filing of the present Writ Petition deserves no consideration. Now, after this length of time, if at all, the writ petitioners are aggrieved from and out of any other further actions, it is left open to the writ petitioners to adjudicate the same in the manner known to law.

4. With these observations, the Writ Petition stands closed. However, there shall be no order as to costs. Consequently, connected miscellaneous petitions are also closed.
