PRAYER:

Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondents 1 to 5 to ensure maintenance of law and order, public tranquility, and avoid communal disharmony by preventing the respondents 6 to 9 from conducting the yearly Panguni Kundam festival between 31.03.2014 and 10.04.2014 at A/M. Periya Ohm Kaliamman Temple, Tiruchengode, Namakkal District in compliance with the order dated 10.03.2014 made in Na.Ka.No.366/2014-C passed by the first respondent till the completion of Thirupani work by considering the representation dated 15.03.2014. Heard Mr.N.Manokaran, learned counsel for the petitioner; Mr.V.Shanmuga Sundar, learned Special Government Pleader for the respondents 1, 2 and 5; Mr.M.Maharaja, learned Special Government Pleader (HR & CE) for the respondents 3 and 4; Mr.M.Devaraj, learned counsel for the sixth respondent; and Mr.P.Valliappan, learned counsel for the respondents 7, 8 and 9 and perused the records.

The Writ Petition has been filed for issuance of Mandamus, directing the respondents 1 to 5 to ensure maintenance of law and order, public tranquility, and avoid communal disharmony by preventing the respondents 6 to 9 from conducting the yearly Panguni Kundam festival between 31.03.2014 and 10.04.2014 at A/M. Periya Ohm Kaliamman Temple, Tiruchengode, Namakkal District in compliance with the order dated 10.03.2014 made in Na.Ka.No.366/2014-C passed by the first respondent till the completion of Thirupani work by considering the representation dated 15.03.2014.

3. The learned Special Government Pleader (HR & CE) for the respondents 3 and 4 submitted that pursuant to the

order of the Revenue Divisional Officer, dated 10.03.2014 issued in Na.Ka.No.366/2014-C, the fit person of Arulmighu Periya Om Kaliamman Temple has not performed any festival, including, Kundam.

4. The learned Special Government Pleader further submitted that reiterating the order dated 10.03.2014, the present Revenue Divisional Officer, Thiruchengode has issued an order dated 08.03.2018. It is further submitted that tense situation is prevailing in that locality and therefore, the fit person has no proposal to conduct any other festival, before Kumbabishegam.

5. Recording the submission of the learned Special Government Pleader, the Writ Petition is closed. However, after performing Kumbabishegam, if conduce situation prevails, the authorities are permitted to perform regular festivals. There is no order as to costs. Consequently, connected miscellaneous petitions are closed.
