Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Declaration declaring that the Group-I services Preliminary Examination results published by the Tamil Nadu Public Service Commission on May 18, 2012 is illegal and ultra vires as far as the petitioner is concerned as it violates guidelines of the Hon'ble Supreme Court of India in Indra Sawhney Case; Shiv Prasad case dated 25.4.2008; M.Nagaraj case dated 19.10.2006 and APPSC case dated 08.04.2009 and provides excessive horizontal reservation, which works detrimental to the merit system. The respondent be ordered to prepare a new list without following the rule of reservation or in the alternative prepare a new list as per the guidelines of the Hon'ble Supreme Court of India by not affecting the 31% Open Competition and applying the horizontal reservation as the 'interlocking' procedure.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) None appears on behalf of the petitioner.

2. The matter pertains to the selection in the year 2012. On 16.02.2017, an order was passed as to why the matter should not be dismissed as nobody was representing the petitioner and thus, ordered to be listed under the caption 'for dismissal'. The petition was then listed again on 31.01.2019 and was ordered to be listed on 14.03.2019 as none represented the petitioner.

3. Today also, none appears and the matter being old by more than ten years, there is no purpose to keep the petition pending. Accordingly, the writ petition is dismissed for nonprosecution. Consequently, M.P.Nos.1, 3 and 4 of 2012 are also dismissed.
