ORDER

The petitioner has filed this contempt petition, to punish the respondents for disobeying the order of this Court in W.P.No.21803 of 2021 dated 08.10.2021.

2.It is submitted that the learned Additional Government Pleader appearing for the respondents also took a chance to assail the aforesaid order in W.A.No.2535 of 2022 vide order dated 17.11.2022. The Writ Appeal was also dismissed by upholding the order of this Court dated 08.10.2021.

3.It is further submitted that despite dismissal of the writ appeal, the respondents are proceedings further with the recovery. Per contra, the learned Additional Government Pleader for the respondents submits that pursuant to order of this Court dated 08.10.2021, in the said writ petition a notice dated 23.11.2021 bearing reference Na.Ka.No.986/A1/2020 has been issued along with the aforesaid notice. The petitioner has also been issued with a copy of the audit objection and that the petitioner has also replied to the same. Pursuant to which, the order has been passed by the fourth respondent/District Educational Officer on 16.12.2021 bearing Na.Ka.No.986/A1/2020. 4.A reading of the aforesaid order indicates a reference to the order of this Court dated 08.10.2021 in W.P.No.21803 of 2021. 5.Considering the above, I do not find any merits in the contempt petition. However, I leave it open to the petitioner to challenge the order dated 16.12.2021 passed by the fourth respondent/District Educational Officer in the manner known to law.
