This application is filed for leave to sue the second defendant before this Court. I heard the learned counsel for the applicant. The learned counsel for the applicant submitted that the suit is filed for recovery of a sum of Rs.1,05,00,000/- with interest thereon from both the defendants. He further submitted that the defendants borrowed a sum of Rs.1,10,00,000/- from the plaintiff at Chennai by executing three promissory notes. Therefore, he submitted that the cause of action has arisen within the jurisdiction of this Court and that this application is filed because the second defendant resides outside the jurisdiction.

2. Upon considering the submissions of the learned counsel and on examining the plaint, I find that a substantial part of the cause of action has arisen within the jurisdiction of this Court. Accordingly, this application is allowed by granting leave to the applicant to file the suit against the second defendant/second respondent. 10.02.2020 gsi http://www.judis.nic.in
