PRAYER: Writ Petitions filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, to call for the records relating to Award dated 24.01.2005 in I.D.No.367/2000 passed by the first respondent, the Learned Presiding Officer, Labour Court, Vellore, quash the award granting reinstatement with backwages, continuity of service and other attendant benefits to the second respondent. It is brought to the notice of this Court that the workman had died.

2. The learned counsel for the writ petitioner states that two persons are claiming as wives of the workman. 1/2 https://hcservices.ecourts.gov.in/hcservices/

3. Under these circumstances, the petitioner company has to ask the legal heirs to produce necessary legal heirship certificate for establishing the validity of the Marriage and in the event of producing any valid legal heirship certificate, the claims of the legal heir shall be settled by the petitioner. Therefore, the writ petitioner/company has to wait for the production of valid legal heir certificate or any succession certificate, whichever is applicable, and thereafter, the amount has to be settled in favour of the legal heirs.

4. With these observations, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
