A. No.957 of 2019 in C.S.No.758 of 2009 PUSHPA SATHYANARAYANA, J.

This application is filed to issue Subpoena to Mr.M.Vinodh, Senior Associate Director of CBRE South Asia Private Limited to produce the report submitted by them to the second and third defendants in respect of the "A" schedule property before this Court.

2. The fourth defendant has filed his counter stating that the CBRE was appointed by the second and third defendants to identify the areas pertaining to the Hotel Complex and the areas pertaining to the Commercial Complex is false and the same was disputed. The plaintiff has stated that CBRE was appointed for the purpose of identifying the areas pertaining to the Hotel Complex and Commercial Complex. However appointment was only in connection with the valuation of the entire property for the purpose of sale and not for the purpose of identifying or demarcating any specific portions. Therefore fourth respondent has stated in its counter without prejudice to its contention in the suit and their rights to cross examine the witness, the application may be allowed. The other defendants 2 and 3 remained ex-parte as early as 06.09.2011. The learned counsel appearing for the seventh and eight defendants and also first defendant did not have any serious objection for allowing this application. Accordingly A.No.957 of 2019 is allowed. http://www.judis.nic.in
