Petition filed under Article 226 of The Constitution of India praying to issue a writ of Certiorarified Mandamus to call for the records pertaining to the order passed by the second respondent in Demand Notice No.003522, dated 06.05.2011, and quash the same, and direct the respondents to confer all the consequential benefits.

Heard Mr.C.Vediappan, learned counsel for the petitioner and Mr.S.T.S.Moorthy, learned Additional Advocate General assisted by Ms.S.Varsha, learned counsel for the respondents.

2. The learned counsel for the petitioner sought the permission of this Court to withdraw the writ petition and also sought liberty to file an appeal as against the impugned order passed by the second respondent dated 06.05.2011 in accordance with law and he has also made an endorsement to that effect.

3. In view of the same, the Writ Petition is dismissed as withdrawn. It is open to the petitioner to challenge the impugned order passed by the second respondent before the Appellate Authority in accordance with law within a period of 10 days from the date of receipt of a copy of this order. this Court had granted an order of interim stay dated 19.05.2011, which is in force till today, the Appellate Authority is directed to entertain the appeal to be filed by the petitioner without insisting on the question of limitation. Consequently, connected Miscellaneous Petitions are closed. No costs.
