PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Certiorarified Mandamus calling for the records of the third respondent dated 20.07.2010 the Memorandum of Settlement entered into under Section 18(1) of the Industrial Disputes Act, 1947 with respect to the portion viz., 'The pay scales drawn out of settlement made after 1.1.1996 shall not be taken as the pre-revised pay scales for the fitment purpose. However, this shall not cover any scale of pay, other allowances etc., which are not at all recognized and approved by Registrar of Cooperative Societies (Housing). Further this fitment shall not be taken as approving any irregular pay revision and other allowances etc., even if it coincides with the fitment formula' and quash the same and consequently direct the 3rd respondent to effect the revision of pay and other allowances retrospectively for the period from 01.01.1996.
