PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, calling for the records
of the third and second respondents in connection with the impugned order of dismissal in PWIRS DP CNC 1097 2010 dated May 27, 2010 issued by the third respondent and confirmed by the second respondent under order dated 23.09.2010 and quash the same and consequently direct the respondent to reinstate the petitioner in service with continuity in service, back wages and all other consequent benefits. The Writ Petition has been filed to call for the records of the second and third respondents in connection with the impugned order of dismissal in PWIRS DP CNC 1097 2010 dated May 27, 2010 issued by the third respondent and confirmed by the second respondent under order dated 23.09.2010 and quash the same and consequently direct the respondent to reinstate the petitioner in service with continuity in service, back wages and all other consequent benefits.
2. When the matter is taken up for hearing, the learned counsel for the petitioner submits a memo before this Court stating that, petitioner is
dead. A letter sent through registered post with acknowledgment was returned with an endorsement " deceased". The return cover is also enclosed herewith. He further submitted that with the death of the petitioner, nothing survives in this petition.
3. In the light of the above, this Writ Petition is dismissed as abated. No costs.
