This case is taken up through video conferencing. 2.

This criminal original petition has been filed seeking to transfer M.C.No.8 of 2017 filed by the respondent, pending on the file of the Judicial Magistrate Court, Thirukoilur to the file of the Judicial Magistrate Court No.I, Hosur or any other Court in Hosur, Krishnagiri District.

For the sake of convenience, the parties will be referred to by their names.

Rajathi got married to Sankaran on 09.09.2015; their marriage ran into rough weather; therefore, Rajathi initiated proceedings in M.C.No.8 of 2017 before the Judicial Magistrate Court, Thirukoilur, under Section 125 Cr.P.C., against Sankaran. 5.

While so, Sankaran, has preferred the present criminal original petition for transfer of M.C.No.8 of 2017 from the file of the Judicial Magistrate Court, Thirukoilur to the file of the Judicial Magistrate Court No.I, Hosur.

Heard Mr.T.M.Karthikeyan, learned counsel representing Mr.T.M.Ramalingam, learned counsel on record for Sankaran. 7.

The learned counsel for the petitioner submitted that there are matrimonial cases pending between the parties in the Subordinate Court, Hosur.

However, information received from the Judicial Magistrate, Thirukoilur, shows that neither Sankaran nor Rajathi are appearing in M.C.No.8 of 2017.

In such view of the matter, this criminal original petition for transfer cannot be maintained and the same is dismissed. Connected Crl.M.P. is closed.
