THE HONOURABLE MS. JUSTICE P.T.ASHA C.R.P.(PD) No.394 of 2019 and C.M.P.No.2703 of 2019 R.Vijayalakshmi ..Petitioner vs.
K.R.Kamalakar ..Respondent PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India against the fair and decreetal order dated 22.10.2018, in I.A.No. 1534 of 2018, in O.P.No. 3733 of 2017, on the file of IV Additional Family Court, Chennai.
For Petitioner : Mr.P.K.Harinath Babu
O R D E R
The above Civil Revision Petition has been filed challenging the visitation right that has been granted to the father, the petitioner in I.A.No.1534 of 2018 in O.P.No.3733 of 2017, to meet his children.
2. The mother, who is the respondent in I.A.No.1534 of 2018 in O.P.No.3733 of 2017 has challenged this order and the learned counsel
appearing for the mother would contend that the children are not ready to meet their father.
3. This Court is aware of the fact that the children who are under the custody of the mother are capable of being tutored by her. In the wholesome interest of the children, it is necessary that, the father should also have access to the children and I find that there is no infirmity in the order passed by the learned IV Additional Family Judge, Chennai.
4. It is made clear that, the mother shall abide by the orders passed by the learned IV Additional Family Judge, Chennai without causing any hindrance to the father having access to the children on the dates as mentioned in the said order.
5. With the above observations, the Civil Revision Petition stands dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed.
