W.P. No.10587 of 2015 : This Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorari to call for the records in proceedings of the 1st respondent in I.A.No.01/2014 in TRAP No. /2014 dated 18/11/2014 and quash the same.

JUDGMENT

(delivered by SATISH K. AGNIHOTRI, J.) Mrs. A. Srijayanthi, learned Special Government Pleader, accepts notice for the respondents. With the consent of the learned counsel on either side, the writ appeal is taken up for final disposal, at the admission stage itself.

The instant intra-Court appeal is directed against the order dated 13.04.2015 rendered in W.P. No.10587 of 2015, wherein, the learned Single Judge, recording the agreement between the parties, observed as under:

x x x x x x x On a perusal of the detailed order passed by the first respondent, it is seen that the first respondent after taking into consideration of the reasons stated in the application for condonation of delay and also having regard to the medical certificate adduced by the third respondent, condoned the delay and I do not find any reason to interfere with the same."

The learned counsel for the appellant fairly submits that there is nothing to question the impugned order on merits, however, a direction be issued to the first respondent to dispose of the appeal within a period of three months, to which, the learned Special Government Pleader appearing for respondents 1 and 2 has no objection. 4.

Accordingly, the first respondent is directed to consider and pass orders on the appellant's appeal on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order.

The writ appeal stands disposed of with the above direction. Costs made easy.
