A.No.463 of 2021 in C.S.No.37 of 2017 R.PONGIAPPAN, J., This application has been filed to condone the delay of 1334 days in filing the written statement of the 4th defendant in C.S.No.37 of 2017.

2. The learned counsel for the respondents has no objection in allowing this application.

3. Having regard to the nature of averments mentioned in the affidavit filed in support of the application and also in order to give a fair opportunity to the applicant to defend the suit, I am inclined to condone the delay.

4. Accordingly, this application is allowed.
