Heard the learned counsel for the petitioner, learned Government Advocate appearing for the respondents 1 and 2 and the learned counsel appearing for the third respondent and perused the materials available on record.
2. This writ petition has been filed challenging the auction proceedings of the respondents 1 and 2 dated 05.05.2017, in and by which, the third respondent was granted licence to run a shop from 01.06.2017 to 31.05.2018.
3. According to the petitioner, the respondents 1 and 2 without issuing proper auction notification had issued a licence to the third respondent in a secret manner.
4. The learned counsel for the third respondent submitted that after following the procedures, the third respondent was issued with a licence and the period of licence has also been expired on 31.05.2018. Subsequently, the second respondent issued an eviction notice, which was challenged by the third respondent in W.P.No.12866 of 2018 and the same was disposed of and hence, the prayer sought for in this writ petition has become infructuous.
5. In the light of the above submissions, this Court is opinion that no further adjudication is required in this writ petition. Accordingly, this writ petition is closed. However there shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
