O R D E R

This Criminal Original Petition has been filed seeking for a direction to the respondent to produce the further witness and complete the trial in C.C.No.39 of 2008 on the file of the XI Metropolitan Magistrate Court, Saidapet, Chennai.

2. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.Side) and perused the materials available on record.

3. The learned Government Advocate (Crl. Side) would submit that the respondent police registered a case as against the petitioner/accused under Sections 406,420,465,467,468 IPC r/w 471 and 408, 477A,468 IPC and filed charge sheet. He further submitted that 43 witnesses were cited as against the petitioner. The petitioner was arrested and remanded to judicial custody. Out of 43 witnesses, only 13 witnesses were examined. However, the trial has not been completed.

Considering the above submissions, without going in to the merits of the case, this Court directs the respondent police to produce further witnesses, and the learned XI Metropolitan Magistrate Court, Saidapet, Chennai is directed to complete the trial in C.C. No. 39 of 2008, within a period of three months from the date of the receipt of a copy of this Order.

5. with the above direction, this Criminal Original Petition is disposed of.
