Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondents to prepare a state wise seniority list of Grade-III Librarians based on the original date of appointment as Village Librarians and grant permissions accordingly as and when vacancies arise.

By consent of both the parties, this writ petition is taken up for final disposal at the time of admission itself.

2. It is the grievance of the petitioner that he was appointed as Village Librarian on 06.08.1997 and was subsequently promoted as Grade III Librarian on 26.10.2006. Whileso, the second respondent, vide proceedings dated 24.04.2008 in Na Ka. No.12220/A1/2008, notified a state level seniority panel for Grade III Librarian, wherein, the name of the petitioner was found at Rank No.756, whereas, one https://hcservices.ecourts.gov.in/hcservices/

K.Saraswathy, who joined the post of Village Librarian on 23.08.1997 i.e. after the petitioner got appointment, was placed at Rank No.349.

Hence, the petitioner sent a representation dated 07.11.2018 to the second respondent, but the same was not considered. Hence, the petitioner has filed the present writ petition seeking appropriate relief.

3. Heard Mr.M.Purushothaman, learned counsel for the petitioner, who submitted that it would suffice, if the representation of the petitioner is directed to be considered by the respondents within a time frame to be fixed by this Court.

4. Mrs.P.Kavitha, learned Government Advocate taking notice for the respondents has no objection in granting such relief to the petitioner.

5. Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court directs the second respondent to consider the representation of the petitioner, dated 07.11.2018 and pass appropriate orders, on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.

6. The writ petition is disposed of in the above terms. No costs. Consequently, connected miscellaneous petition is closed.
