The petitioner claiming to be the owner of the land in Survey Nos.397, 398, 400, 401/1C and 401/3, has chosen to file the present writ petition to forbear the respondents from constructing Ladies' Hostel for Law College students in the Poramboke land of 70 cents situated on the southern side of the above said land.

2. Heard the learned counsel appearing for the petitioner.

3. The only objection raised by the petitioner is that there are other suitable lands for constructing the ladies hostel and https://hcservices.ecourts.gov.in/hcservices/

therefore, the present attempt of utilizing the Poromboke land adjacent to the petitioner's land should be avoided.

I do not find any justification on the part of the petitioner in making such claim, as admittedly, the proposed construction of the ladies hostel is not going to take place in the petitioner's patta land and on the other hand, it is proposed at the Poromboke land belonging to the Government, with which the petitioner cannot have any objection / claim, whatsoever. It appears that the petitioner, apart from the above said lands claimed to be in possession, also seeks to enjoy the Government Poromboke land as well and thus, has chosen to make this unreasonable and unjustifiable claim. Hence, I find no merits to entertain this writ petition. Accordingly, this writ petition fails and the same is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
