ORDER

The petitioner, who apprehends arrest at the hands of the respondent for the offences punishable under Sections 406, 420, 294(b) and 506(2) of IPC, in Crime 1 / 4

No.416 of 2024, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant is the owner of 5 cars; that she has given the cars for business purpose to the petitioner; that the petitioner has neither paid the rental amount nor returned the cars; that the value of the cars is more than Rs.20 lakhs.

3. Learned counsel appearing for the petitioner submits that this is the second bail application; that the earlier bail application was dismissed by Hon'ble Mr.Justice A.D.Jagadish Chandira in Crl.OP.No.32561 of 2024 dated 24.01.2025 on the ground that the cars have not yet been recovered and hence prayed for anticipatory bail to the petitioner.

4. Learned counsel for the Intervener vehemently opposed for the grant of anticipatory bail to the petitioner.

5. Learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing the grant of anticipatory bail to the petitioner, reiterated the prosecution case and on instructions, submitted that the cars have not been recovered.

6. Heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) appearing for the respondent police and perused the 2 / 4

materials available on record.

7. Considering the nature of allegations, and since there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
