Respondents PRAYER: This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to conduct an enquiry on the petitioner's representation dated 06.12.2017 regarding the cancellation of the forged sale deed registered before the Sub Registrar, Nagoor, Nagapattinam in Document No.543/2000.

O R D E R

This writ petition has been filed, directing the respondents 1 to 3 to conduct an enquiry on the petitioner's representation dated 06.12.2017 regarding the cancellation of the forged sale deed registered before the Sub Registrar, Nagoor, Nagapattinam in Document No.543/2000. However, such power is not available, to the respondents 1 to 3 for cancellation of the sale deed. That power is available only before the competent civil court.

2. In view of the decision rendered by this Court in the case of M.Kathirvel Vs. The Inspector General of Registration Department and others in W.P No.10291 of 2022 etc. batch dated 02.08.2024 reported in 2024 SCC OnLine Mad 6154, Section 77A of the Tamil Nadu Registration Act is struck down.

3. Accordingly, this writ petition is dismissed. No costs. However, liberty is granted to the petitioner to approach a competent civil court for appropriate relief.
